§ 1 Validity

These General Terms and Conditions (GTC) apply to all further training, training courses, consultations and services (hereinafter all referred to as "training courses") provided by CRS medical GmbH as part of the "ErstHeldenSchmiede" program, which are in the broadest sense attributable to the field of first aid, emergency and resuscitation training. The customer accepts these terms and conditions vis-à-vis CRS medical GmbH by booking a training course. Any other terms and conditions used by the customer must be expressly confirmed in writing by CRS medical GmbH in order to be included. Insofar as the masculine form is used in the provisions of these General Terms and Conditions, this is done solely for linguistic simplification. The provisions also apply equally to female and diverse customers and participants.

§ 2 Contractual partners, target group

The training offer is aimed at clubs, driving schools and other companies and expressly not at consumers within the meaning of § 13 BGB. The training contract is concluded between CRS medical GmbH and the respective association or company ("customer"). Individual contractual relationships with the training participants (e.g. club members, employees, learner drivers) do not arise.

§ 3 Conclusion of the training contract

Training requests can be sent to CRS medical GmbH by e-mail (erstheldenschmiede@crs-medical.com). A training contract with the confirmed number of participants shall not come into effect before the contractual partner receives the booking confirmation from CRS medical GmbH in written or text form (e-mail is sufficient). 

§ 4 Training services

The training offer includes the training courses listed under § 1. Depending on the agreement reached, the following contents may be the subject of the training courses:
- Recognizing life-threatening incidents
- Rescue from the danger zone
- Disturbance of consciousness/respiration and circulation
- Checking vital functions/ communicating with affected persons
- Cardiopulmonary resuscitation/ use of an AED
- Wounds/ wound care/ life-threatening wounds/ shock
- Joint injuries/ broken bones
- Burns/ frostbite
- Poisoning/ chemical burns
On request, training courses can be individually designed according to the wishes of the respective customer and additional services (e.g. catering packages) can be booked.
    

§ 5 Training location

The training courses generally take place on the premises of CRS medical GmbH at Loherstraße 6, 35614 Asslar. At the customer's request, a different training location may be agreed if CRS medical GmbH deems it suitable.

§ 6 Terms of payment

Upon conclusion of the training contract, the customer undertakes to pay the agreed total participation fee. This shall also include the cancellation fees incurred in the cases of § 8.
The total participation fee shall be invoiced to the customer after the end of the training course, in the event that the entire training course is canceled after the cancellation. 

§ 7 Certificate of attendance

CRS medical GmbH shall issue certificates of attendance to individual participants if the respective participant was present for at least 90% of the training period and the total participation fee for the training has been paid in full by the customer.

§ 8 Cancellation

Cancellation of the entire training course or individual participants must be made by e-mail to: erstheldenschmiede@crs-medical.com. Cancellation by telephone is not possible.
The customer may cancel his/her registration free of charge for individual participants up to 14 days before the start of the training course.
If individual participants cancel 14 days or more before the start of the training, the training fees for each canceled participant will be charged as follows:

Participants who do not show up on the day of the course are deemed to have canceled the course.
If a replacement participant is registered up to 7 days before the start of the training course, there is no cancellation fee. Re-registration is only possible once free of charge. In the event of a further re-registration, 25% of the course fees will be charged.
If the agreed minimum number of participants is not reached as a result of cancelations, the provisions of § 10 shall apply.
 

§ 9 Ausschluss von Teilnehmern

Die CRS medical GmbH ist berechtigt, Teilnehmer bei Vorliegen eines wichtigen Grundes von der (weiteren) Teilnahme an der Schulung auszuschließen. Ein solcher wichtiger Grund liegt insbesondere vor, wenn ein Teilnehmer
-    die Schulung fortwährend stört und damit den Schulungserfolg anderer Teilnehmer gefährdet
-    Hygieneanweisungen der CRS medical GmbH auch auf gesonderte Aufforderung hin nicht Folge leistet
-    durch Erkrankung ein Ansteckungsrisiko für andere Teilnehmer darstellt.
Im Falle eines Ausschlusses behält die CRS medical GmbH den vollen Anspruch auf die Teilnahmegebühr.

§ 10 Absage der Schulung

Die CRS medical GmbH behält sich vor, Schulungen abzusagen, wenn diese aus Gründen höherer Gewalt oder wegen unvorhergesehener Erkrankung der Schulungsperson nicht durchführbar sind oder wenn die vereinbarte Mindestteilnehmerzahl (ggf. nach Stornierungen) nicht (mehr) erreicht wird. Die CRS medical GmbH wird den Kunden unverzüglich über den Ausfall informieren und in angemessenem Zeitraum einen oder mehrere Ersatztermine anbieten. Rechtsansprüche des Kunden im Zusammenhang mit einer solchen Absage bestehen nicht.

§ 11 Haftungsbeschränkung

Die CRS medical GmbH haftet für jede Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer eigenen schuldhaften Pflichtverletzung oder einer solchen ihres gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen. Im Übrigen sind Schadensersatzansprüche ausgeschlossen, soweit sie nicht auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung der CRS medical GmbH oder ihres gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen.
Für Verlust, Diebstahl oder Beschädigung von Garderobe oder sonstigen im Rahmen der Schulung mitgeführten Gegenständen übernimmt die CRS medical GmbH grundsätzlich keine Haftung.

§ 12 Urheberrecht

Die Schulungsunterlagen dürfen nicht ohne Einwilligung der CRS medical GmbH vervielfältigt oder verbreitet werden.

§ 13 Datenschutz

Die mit der Buchung erfassten personenbezogenen Daten werden mit der Absicht erfasst und verarbeitet, eine ordnungsgemäße Schulung zu gewährleisten. Dabei wird die europäische Datenschutzgrundverordnung (DSGVO) eingehalten.

§ 14 Schluss

Gerichtsstand für beide Vertragsparteien ist Wetzlar.
Sollte eine Bestimmung dieser Teilnahmebedingungen (AGB) unwirksam sein, wird die Wirksamkeit der übrigen Bestimmungen davon nicht berührt. Anstelle der unwirksamen Bestimmung ist eine dieser Bestimmung möglichst nahekommende wirksame Regelung zu treffen.

§ 9 Exclusion of participants

CRS medical GmbH is entitled to exclude participants from (further) participation in the training for good cause. Such good cause exists in particular if a participant
- continually disrupts the training and thus jeopardizes the training success of other participants
- does not follow the hygiene instructions of CRS medical GmbH, even when specifically requested to do so
- poses a risk of infection for other participants due to illness.
In the event of exclusion, CRS medical GmbH shall retain full entitlement to the participation fee.

§ 10 Cancellation of the training

CRS medical GmbH reserves the right to cancel training courses if they cannot be held for reasons of force majeure or due to unforeseen illness of the trainer or if the agreed minimum number of participants (if applicable after cancelations) is not (or no longer) reached. CRS medical GmbH shall inform the customer immediately of the cancellation and offer one or more alternative dates within a reasonable period of time. The customer shall have no legal claims in connection with such a cancellation.

§ 11 Limitation of liability

CRS medical GmbH shall be liable for any injury to life, limb or health caused by its own culpable breach of duty or that of its legal representative or vicarious agent. Otherwise, claims for damages are excluded unless they are based on an intentional or grossly negligent breach of duty by CRS medical GmbH or its legal representative or vicarious agent.
CRS medical GmbH accepts no liability for loss, theft or damage to clothing or other items brought along during the training.

§ 12 Copyright

The training documents may not be reproduced or distributed without the consent of CRS medical GmbH.

§ 13 Data protection

The personal data collected with the booking is collected and processed with the intention of ensuring proper training. The European General Data Protection Regulation (GDPR) is complied with.

§ 14 Conclusion

The place of jurisdiction for both contracting parties is Wetzlar.
Should any provision of these Terms and Conditions of Participation (GTC) be invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to the invalid provision.
